Appeals against decisions by APEH in wealth gain (vagyonosodási) investigations are successful in half of cases, a much higher rate than in other investigations, writes Napi.hu, based on data provided by the tax office.
Between January 2007 and June 2008, 2,644 appeals were sent to APEH in relation to wealth gain investigations. In 49% of cases, the first-degree decision was changed, and the case either annulled or returned for a new investigation. Meanwhile, in relation to decisions in other investigations, 11,000 appeals were submitted by taxpayers last year, of which only 1451 were returned for a new investigation and 896 altered.
In wealth gain cases brought to court, the results were also often successful for taxpayers, with courts deciding in their favor in 29% of cases.
Despite data showing that taxpayers should appeal against decisions in wealth gain investigations, the relatively low number of appeals compared to the total number of inspections show that most people would rather pay the tax and fines than start arguing with the tax office.
